Many people believe Wills avoid probate. They do not.
A WILL DOES NOT AVOID PROBATE.
A Will is simply your legal direction of how to distribute your assets after your death. The Will goes to the judge of the Probate Court. It is the duty of the probate judge to read your Will and follow your directions.
However, if all your assets are in Arizona we can use a Will as part of an estate plan to avoid probate in many cases. A Will is only one document in a properly done estate plan, it is not the only document a person needs to properly plan.
