Guardianship


Generally speaking, a guardianship is a court proceeding to appoint a person to make health care decisions for you and a conservatorship is a court proceeding to appoint a person to make financial decisions for you. A person in need of one of these will need both.

Court proceedings are always time consuming and expensive. Part of your planning should be to avoid courts whenever possible.

Neither Intestate Succession nor a Will provide protection against a Guardianship or a  Conservatorship. However, proper planning does provide this protection.
